اختلاف در چیست؟

داوود هرمیداس باوند، حقوقدان ایرانی اخیرا به مناسبت بالا گرفتن دور تازه اختلافات بر سر جزیره ابوموسی، در مقاله ای برای روزنامه شرق چاپ تهران نوشته است که جزایر سه‌گانه خلیج‌فارس بخشی از تمامیت ارضی ایران است و هر ایرانی می‌تواند به هر بخش از خاک سرزمینش سفر کند و نیازی به توضیح ‌دادن در این‌باره به کشورهای دیگر ندارد.

آقای باوند در شرح تاریخی اختلافات ایران و امارات نوشته است که در سال ۱۹۰۳ دولت ایران بازنگری‌هایی درخصوص نقشه‌های جغرافیا آغاز کرد که بر اساس آن در برخی بنادر، گمرکی به وجود آمد و پرچم ایران نصب شد که این مساله درباره ابوموسی و تنب‌بزرگ نیز اعمال شد.

به نوشته آقای باوند دولت بریتانیا که حاکمیت بلامنازعی در آب های خلیج فارس داشت مامورین گمرک ایرانی را از تنب‌بزرگ اخراج کرد و همزمان با بحران های سیاسی ناشی از مشروطه، اعتراضات ایران به بریتانیا به جایی نرسید تا جایی که پرچم شارجه در تنب‌بزرگ نصب ‌شد.

بر اساس این نوشته "بریتانیا ادعا می‌کند که چون جزیره ابوموسی پیش از این اشغال نشده و شارجه نخست آن را اشغال کرده پرچم این امارت‌نشین را در آن نصب می‌کنند. این در حالی است ‌که در تمام اسناد حکومتی در بریتانیا در قرن ۱۹ تنب‌بزرگ و ابوموسی و دیگر جزایر خلیج‌فارس جزو ارباب جمعی حاکمیت فارس آورده شده‌اند و حتی در نقشه‌های رسمی دولت بریتانیا خصوصا نقشه‌های وزارت دفاع، این جزایر به رنگ ایران مشخص شده بودند."

به گفته آقای باوند این جزایر نه جدیدالاکتشاف هستند و نه رها شده بودند. در نهایت در هشت آذر ۱۳۵۰ با قراردادی که با میانجی‌گری بریتانیا میان دولت ایران و شیخ شارجه بسته شد، حاکمیت ایران بر جزیره ابوموسی به رسمیت شناخته شد و در ۹ آذر، یک روز قبل از خروج نیروهای انگلیسی از منطقه و دو روز قبل از تشکیل رسمی اتحادیه امارات، نظامیان ایران وارد سه جزیره شدند.

بر اساس نوشته داوود هرمیداس باوند، به موجب موافقت‌نامه شارجه، ایران متعهد شد که به مدت ۹ سال، سالیانه یک‌ونیم‌ میلیون لیره به شیخ شارجه بپردازد.

مطابق این تفاهمنامه، دو جزیره تنب بزرگ و تنب کوچک به ایران بازپس داده شد و در مورد ابوموسى، توافق شد که "حاکمیت مشترک ایرانى- شارجه‌اى" بر آن اعمال شود.

گیو میرفندرسکی، صاحب نظر حقوق بین الملل که درباره موضوع حاکمیت جزایر سه گانه تحقیق آکادمیک کرده است، می گوید که ایران و شارجه بر اساس یادداشت تفاهمی در سال ۱۹۷۱ منافع خود از جمله حدود آب های ساحلی و درآمد نفت را از یکدیگر "تفکیک" کردند.

چند روز پس از امضای یادداشت تفاهمی میان ایران و حاکم شارجه، کشور تازه‌ای به نام امارات متحده عربى به وجود آمد.

بهمن آقایی دیبا، کارشناس حقوق بین الملل در آمریکا می گوید که بعد از سال ۱۹۷۱ حاکمیت بر جزایر برای طرف ها اهمیت بیشتری پیدا کرد.

به گفته او خروج نظامی بریتانیا از منطقه و کشف نفت در اطراف جزایر، حاکمیت بر جزایر را مهم و تاثیرگذار کرده بود.

به فاصله چند هفته پس از تاسیس امارات، حکومت های عراق، لیبی، الجزایر، یمن جنوبی و کویت، ادعای "اشغال" سه جزایر را در شورای امنیت سازمان ملل متحد مطرح کردند، اما این شورا با استناد به تفاهم نامه ۱۹۷۱ اعتراض آنها را وارد نداست و بررسی آن را در دستور کار قرار نداد.

شورای همکاری خلیج فارس که امارات یکی از اعضای آن است در حدود سه سال پیش توصیه به ارجاع این اختلاف به دیوان بین المللی دادگستری (لاهه) کرده بود.

ایران هنگام پذیرفتن صلاحیت دادگاه بین المللی لاهه، حق تحفظ (حق موافقت با ارجاع پرونده به دادگاه) را برای خود محفوظ دانسته و بنابراین در صورتی که امارات خواستار ارجاع پرونده اختلاف به لاهه باشد، نیازمند موافقت ایران با این موضوع است.

دولت ایران سه جزیره تنب بزرگ و تنب کوچک و ابوموسی را جزو جدانشدنی این سرزمین می داند، اما وزارت خارجه ایران اعلام کرده است که بر اساس یادداشت تفاهم سال ۱۹۷۱ با امارات، حاضر است درباره اختلافات گفت و گو و آن را با شیوه مسالمت آمیز حل کند.
